Best Practices in European Restructuring

Contractualised Distress Resolution in the Light of the Directive Proposal of 22 November 2016

   

The University of Florence (L. Stanghellini/R. Mokal), the Humboldt Universität zu Berlin (C. Paulus) and the Universidad Autónoma of Madrid (I. Tirado) have held a full-day workshop in Brussels to present the results of the research project, debate the results with attendants and foster critical analysis thereof, and discuss the implications of the project´s outcome on the Directive Proposal of 22 November 2016.

The workshop took place in Brussels at the Centre for European Policy Studies (CEPS), on the 5th July 2018 (see the Agenda). It has benefited from the participation of international experts in insolvency law, members of the European Commission, academics and professionals, who have contribute actively to the debate.

Finally, several documents have been  circulated among participants in prepration of the workshop: the final report, a summary of guidelines and policy recommendations, suggestions for the re-drafting of the Directive Proposal (COM(2016) 723 final), and the national findings of the four jurisdictions involved in the reaserch (Germany, Italy, Spain, and the U.K.). All documents are made available in a provisional version with the purpose of inviting comments for further development. See the relative page, HERE.
